1. Nature of the Protocol

DeFiEscrow is a decentralized, non-custodial software protocol consisting of smart contracts deployed on various blockchain networks (the "Protocol"). DeFiEscrow does not act as an escrow agent, intermediary, or fiduciary. The Protocol operates autonomously based on programmatic logic ("Code is Law").

2. NO WARRANTIES (AS-IS)

THE PROTOCOL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Protocol will be uninterrupted, error-free, or free of harmful components. You acknowledge that smart contracts are experimental technology and may contain "bugs," errors, or vulnerabilities that could lead to the total loss of funds.

3. ABSOLUTE LIMITATION OF LIABILITY

IN NO EVENT SHALL THE DEVELOPERS, CONTRIBUTORS, OR ANY AFFILIATED PARTIES BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE PROTOCOL OR THE USE OR OTHER DEALINGS IN THE PROTOCOL.

This limitation includes, but is not limited to, liability for:

• Errors or mistakes in the smart contract code or logic.
• Unauthorized access to or alteration of your transmissions or data.
• Loss of funds, tokens, or any digital assets due to contract vulnerabilities or exploits.
• Financial losses resulting from the misuse or incorrect configuration of the Protocol by the user or any third party.
• Blockchain network failures, congestion, or "forks."

4. USER RESPONSIBILITY & ASSUMPTION OF RISK

You are solely responsible for your use of the Protocol. You represent and warrant that you have sufficient knowledge and experience in blockchain technology to understand the risks involved.

By interacting with the Protocol, you voluntarily assume all risks associated with the use of decentralized software, including the risk that your funds may be permanently lost or rendered inaccessible. We are not responsible for the way the Protocol is used by you or any other party to a settlement arrangement.

5. INDEMNIFICATION

You agree to release, indemnify, and hold harmless the developers and contributors of DeFiEscrow from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Protocol or your violation of these Terms.

6. MODIFICATIONS

We reserve the right to modify these Terms at any time without notice. Your continued use of the Protocol following any changes constitutes acceptance of the updated Terms.
